[Krishna Janmabhoomi-Shahi Eidgah Mosque case] Allahabad HC allows plea seeking appointment of Court commissioner for inspecting the Mosque

This application had been moved in the original suit, presently pending in the High Court concerning Mathura’s Krishna Janmabhoomi-Shahi Eidgah Mosque dispute.

Allahabad High Court: In an application filed Order 26 Rule 9 of the Code of Civil Procedure, 1908 by Bhagwan Shri Krishna Virajman and seven other Hindu parties concerning the Mathura’s Krishna Janmabhoomi-Shahi Eidgah Mosque dispute, Mayank Kumar Jain, J. has allowed the plea seeking appointment of Court commissioner for inspecting Eidgah Mosque.

The applicants claimed that Sri Krishna’s birthplace lies beneath the Mosque and that there are many signs which establish that the Mosque is a Hindu temple hence, a commissioner should be appointed.

The suit was earlier dismissed by the Civil Court on the ground of the bar on admitting under the Places of Worship (Special Provisions) Act, 1991. However, this was overturned after an appeal before the Mathura District Court.

In 2023, the High Court allowed a plea moved by the Hindu parties seeking transfer of the suit from the Trial Court to the High Court.

The Hindu parties have also moved to the Supreme Court against the Allahabad High Court’s dismissal for a survey of the premises of the Shahi Eidgah mosque that neighbours the Shri Krishna Janmabhoomi temple. The Supreme Court refused to entertain the plea.
