Supreme Court: In a challenge against Allahabad High Court’s order allowing the appointment of a Commissioner to inspect the Mathura’s Shahi Mosque Eidgah, the Division Bench of Sanjiv Khanna and SV Bhatti, JJ. dismissed the appeal and refused to interfere with the impugned order.
In the matter at hand, the survey of Shahi Mosque Eidgah, Mathura was sought on the grounds that there exist remains of Hindu temple beneath the Mosque. The High Court had allowed a transfer application under Section 24 of the Code of Civil Procedure, 1908 whereby, the number of suits pending before the Civil Judge (Senior Division), Mathura were transferred to the High Court, considering the seminal public importance which affected the masses beyond tribe and beyond communities.
The High Court had allowed the plea to appoint a Commissioner to inspect the Eidgah Mosque, forming the impugned order.
The Court refused to stay the High Court’s order.
