NGT orders for periodic monitoring of illegal sand mining activities and environmental violations in MP’s Tamia

The National Green Tribunal emphasised on the necessity for appropriate action, including prosecution and environmental compensation, in case of violations.

National Green Tribunal: In a suo moto application initiated based on a news item published in Patrika dated 18.12.2023 “Nadi — Nalo ka seena kiya chalni, dekhiye video ret ka avaidh khanan”, a division bench comprising of Sheo Kumar Singh, J., (Judicial Member) and Dr. A. Senthil Vel (Expert Member), directed the concerned authorities to monitor the area periodically for illegal mining activities and environmental violations.

The NGT noted that the news item highlighted large-scale illegal mining in the Tamia area, endangering the existence of rivers and rivulets, and leading to a decrease in water levels. It also reported the seizure of three tractors loaded with sand, indicating rampant illegal mining activity. The NGT took cognizance of the matter on 09-01-2024, issuing notices to the respondents based Municipal Corpn. of Greater Mumbai v. Ankita Singh, 2021 SCC OnLine SC 897. The NGT, via order dated 26-02-2024, constituted a committee to visit the site and submit a factual report on the actions taken.

The NGT noted that the State Pollution Control Board in its report informed that, during inspections conducted by officials from various departments, no illegal mining activity was observed. However, local villagers reported recent instances of sand mining and subsequent seizure of vehicles by government officials.

In light of the reports and facts presented, the NGT directed the State PCB, Regional Office, and Mining Officer to periodically monitor activities in the Tamia area for illegal mining and environmental rule violations. The concerned authorities are also instructed to take necessary action, including prosecution and realization of environmental compensation, in case of any violations. The NGT disposed of the application with the above observations.
