Airports Economic Regulatory Authority not barred from filing appeals challenging orders of TDSAT: Supreme Court

TDSAT had ruled that AERA lacked the authority to regulate tariffs for services like Ground Handling Services (GHS) and Cargo Handling Services (CHS).

Supreme Court: The 3-Judge Bench of Dr DY Chandrachud, CJI, JB Pardiwala and Manoj Misra, JJ., on 18-10-2024 held that Airports Economic Regulatory Authority of India (AERA) can file appeals challenging orders of the Telecommunications Dispute Settlement and Appellate Tribunal (TDSAT).

The TDSAT had ruled that AERA lacked the authority to regulate tariffs for services like Ground Handling Services (GHS) and Cargo Handling Services (CHS), categorising them as ‘Non-Aeronautical Services’.

The Supreme Court is to hear matter concerning fares that passengers have to pay for airport facilities, ground handling, cargo operations and post-flight services.
