Challenge against constitution of Selection Committee to appoint Director of School of Planning & Architecture; Delhi High Court issues notice

The challenge is filed by Prof. Dr. Pratap Manohar Raval, an aspirant to the post of Director of School of Planning & Architecture, New Delhi.

Delhi High Court: In a petition filed by Prof. Dr. Pratap Manohar Raval (petitioner) challenging the constitution of the Selection Committee as constituted by Union of India (respondent 1), Tushar Rao Gedela J., issues notice to the respondents which has been duly accepted.

The challenge by an aspirant to the post of Director of School of Planning & Architecture, New Delhi is pertaining to the Committee comprising a chairperson, who is required to be an eminent person from the field of Architecture or Planning, as also two Experts from the field of Architecture or Planning. The main grievance of the petitioner is that the incumbent chairperson is not a person who is from the field of Architecture or Planning.

Counsel for the petitioner submitted that the Committee which has been constituted violates Clause 17(1) of the Schools of Planning and Architecture Statute, 2016 as notified by the Ministry of Human Resources and Development vide the Gazette Notification dated 13-10-2016.

The Court after noting the relevant provisions and credentials of the chairperson of the Selection Committee Praveen Kumar, directed the Central Government to file the reply within 10 days and posted the matter for 25-05-2023.

Thus, the Court issued notice to the respondents and held that the selection committee formed to recommend a candidate to the President for the post of Director, School of Planning and Architecture, would be subject to the outcome of the writ petition.
