Supreme Court: Sanjiv Khanna, J. has dismissed the appeal against Allahabad High Court’s order, whereby fifteen suits regarding the Krishna Janmabhoomi-Shahi Idgah Masjid dispute were consolidated to avoid conflicting judgments and in the interest of justice.
Several suits of similar nature regarding the land 13.37 acre and for removal of the disputed structure- Shahi Idgah Masjid from the land in question were filed. It was submitted before the High Court that eighteen suits were filed till date. It was sought before the High Court that pending suits be consolidated with the petitioner’s suit, as by consolidating the suits, the time of the Court and the expenses of the parties can be saved. The High Court vide order dated 11-01-2024, allowed the prayer for consolidation of the suits pending before the High Court for trial. The High Court said the pending suits were similar and can be decided simultaneously based on common evidence. The Suit No. OSUT 01/2023 Bhagwan Shri Krishan Virajman at Katra Keshav Dev Khewat No. 255 v. U.P. Sunni Central Waqf Board was made as the leading case.
The Court, while dismissing the appeal, said that an application to recall the impugned order was pending before the High Court.
