Supreme Court: In an appeal filed by National Investigating Agency (‘NIA’) against the order passed by Bombay High Court, wherein the Court granted bail to Gautam Navlakha accused in the Bhima Koregaon violence case of 2018, the division bench of MM Sundresh and SVN Bhatti , JJ. has lifted the stay on the Bombay High Court order granting him bail.
The Court was also hearing his plea concerning the terms of his house arrest along with the bail matter.
Gautam Navlakha was initially lodged in prison, but later he was shifted to his house and placed under house arrest in 2022 after the Supreme Court allowed his plea for the same, on the ground of his advanced age. He has since been under house arrest in Navi Mumbai.
Later, the Bombay High Court granted him regular bail but stayed that order for three weeks to enable NIA’s appeal before the Supreme Court.
The Court said the Trial would take years to complete. Thus, without going at length into contentions, the Court refused to extend the stay.
The Bench also viewed that, there is no need for extending the interim order of stay as Gautam Navlakha has been in incarceration for more than four years.
