Supreme Court issues directions to release pending salary & arrears of Patna High Court Judge, Justice Rudra Prakash Mishra

The aggrieved High Court Judge had approached the Supreme Court stating that he had not received any salary since his appointment due to absence of a General Provident Fund (GPF) account.

Supreme Court: The 3-Judge Bench of Dr DY Chandrachud, CJ, JB Pardiwala and Manoj Misra, JJ., on 30-9-2024, issued interim order to the State of Patna to release pending salary of Justice Rudra Prakash Mishra of Patna High Court.

The aggrieved High Court Judge had approached the Supreme Court stating that he had not received any salary since his appointment on 4-11-2023 (ten months) due to the absence of a General Provident Fund (GPF) account.

Taking strict note of the matter, the Bench observed that “No judge can be expected to work without payment of salary”; and therefore, directed the State to pay all pending salaries and arrears from the date Justice Mishra was entitled and to open a temporary General Provident Fund account.
